Changing or Transferring Title in Arizona

There will be times when you need to change the information on the deed or title to your land or transfer the ownership of the land to another party. You do not always need the services of an attorney for this.

Options When Changing or Transferring Title in Arizona

When changing or transferring the title to land in Arizona, you have several options. There are Quit Claim Deeds, Warranty Deeds, and Special Warranty Deeds. Once you have determined which type of deed or title you need, then you can use an Arizona transfer of title service such as Arizona Legal Briefcase.

A Quit Claim Deed does not carry the same warranty that the Grant Deed carries. It merely transfers the grantor’s title, claim, and interest in the property to another person. A Quit Claim Deed carries not guarantees.

Warranty Deeds not only transfer ownership of the property, it also states that the grantor has a good and lawful title to the property and has the legal authority to sell the title. Warranty Deeds are more of a contract between the two parties. Should problems arise in the future with the title to the land, the grantee (buyer) can sue the grantee (seller) for damages.

Special Warranty Deeds state that the grantor guarantees that the grantor has not encumbered the property during the time he or she owned it. It does not guarantee that the title was clear when the grantor purchased the property.

We do offer the option of having your documents emailed to you. Once you have printed them out and reviewed them, you can then sign them in front of your own notary. You will then need to take them to the County Recorder’s Office to for recording and pay the recording fees. This self-service option is usually only $90.
